Insurance Agent (“Application”) – End User License Agreement
This End User License Agreement (“Agreement”)outlines the terms related to your use of this Application provided to you byBlue I, LLC (“Blue I” dba “Insurance Agent App”). For purposes of thisAgreement, you will be referred to as “You” or “End User” and Blue I, LLC shallbe referred to as “Our” or “Blue I”.
ThisAgreement does not change or amend in any way the Usage Rules set forth on Apple’s App Store or the Google Play Store Terms and Conditions.
BYDOWNLOADING OR USING THE APPLICATION ONLINE, YOU ACCEPT THESE TERMS AND AGREETO HAVING YOUR INSURANCE POLICY DATA TRANSMITTED DIGITALLY FOR DISPLAY WITHINTHE APPLICATION. IF YOU DO NOT ACCEPT THEM, OR DO NOT AGREE TO HAVING YOURINSURANCE POLICY DATA TRANSMITTED DIGITALLY, DO NOT DOWNLOAD OR USE THEAPPLICATION.
IF YOUACCESS ANY INTERNET-BASED SERVICES VIA LINKS IN THE APPLICATION, YOUR USE OFTHOSE SERVICES WILL BE SUBJECT TO BOTH THIS AGREEMENT AND ANY SEPARATELY PROVIDEDTERMS OF USE AND PRIVACY STATEMENT ON SUCH WEBSITE.
Blue Ireserves the right, in its sole discretion, to modify or change the terms Agreement at any time without prior notice to You. Your continued use ofthe Application following the posting of any changes to the Agreement constitutes acceptance of those changes.
License
Blue I grants You a non-transferrable license to use the Application on any Apple iOS powered device, Google Android powered device, or online via a web browser thatYou own or control and as permitted by the Usage Rules set forth in Apple’sApp Store Terms and Conditions and the Google Play Terms and Conditions. All rights not expressly granted to you arereserved by Blue I and its licensors.
You shallnot (i) license, sublicense, sell, resell, transfer, assign, distribute or otherwisecommercially exploit the Application or its content in any way; (ii) modify ormake derivative works based upon the Application or the content.
You mayuse the Application only for your own personal or internal business purposesand shall not: (i) send junk mail or otherwise duplicative or unsolicitedmessages in violation of applicable laws; (ii) send or store infringing, obscene, threatening, libelous, or otherwise unlawful material, including material in violation of third party privacy rights; (iii) send or store material containing software viruses, worms, Trojan horses, malware or otherharmful computer code, files, scripts, agents or programs; (iv) interfere withor disrupt the integrity or performance of the Service or the data containedtherein; or (v) attempt to gain unauthorized access to the Application or itsrelated systems or networks.
Disclaimer of Warranty
The Application is licensed “as-is,” “with all faults,” and “as available.” You bear the risk of using it. Blue I, on behalf of itself, distributors of the Application, network operators over whose network the Application is distributed, and each of their respective affiliates and suppliers, gives no express or implied warranties, guarantees, or conditions under or in relation to the Application, including, but not limited to, implied warranties of merchant ability and fitness for a particular purpose. Blue I does not warrant that the functionality or operation of the Application will be uninterrupted or free from error, that any defects in the Application will be corrected, or that the Application or the server(s) that makes it available are free of viruses orother harmful conditions or components.
Disclaimerof Accuracy and Use of Data
ByRegistering to use Insurance Agent App you agree to receive your property andcasualty insurance policy information electronically. Although the data found here has been produced and processed from third party sources believed to bereliable, no warranty expressed or implied is made regarding accuracy, adequacy, completeness, legality, reliability or usefulness of any data. This disclaimer applies to both isolated and aggregate uses of the data. Blue I provides this information on an "AS IS" basis. All warranties of anykind, express or implied, including but not limited to the IMPLIED WARRANTIESOF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, data accuracy andnon-infringement of proprietary rights ARE DISCLAIMED.
Changes may be periodically added to the data herein; these changes may or may not be incorporated in any new version of the Application. If Blue I has obtained this information from a source other than the End User, the End User must be awarethat electronic data can be altered subsequent to original distribution. Data can also quickly become out-of-date. If the user finds any errors or omissions, Blue I encourages the End User to report them to the entity that made the Application available for the End User.
Disclaimerof Endorsement
Regardingthe data provided in the Application, Blue I is a distributor of data suppliedby third parties. Any opinions, advice, statements, services, offers, or other informationor content expressed or made available by third parties, including informationproviders, users, or others, are those of the respective author(s) and do notnecessarily state or reflect those of Blue I. Reference herein to any specificcommercial products, process, or service by trade name, trademark,manufacturer, or otherwise, does not constitute or imply its endorsement,recommendation, or favoring by Blue I, and such reference shall not be used foradvertising or product endorsement purposes.
Support Services
TheApplication is provided “as is.” Neither distributor of the Application, Yourphone manufacturer, Your network operator, or Your online web browser areresponsible for providing maintenance or support services for the Application.
Jurisdictional Statement
ThisApplication is controlled, operated and intended for use only in the UnitedStates of America. We do not represent that materials in this Application areappropriate or made available for use outside of the United States of America.
Your Personal Information
If Youregister to use the Application, Blue I asks for your email address, name,address and telephone number – “Personal Information” - to enhancecommunication within the Application between You and your insurance agent. Photos and related information you add willbe stored on a secure server which you can access only through the Application ona mobile device with an Apple iOS or Google Android operating system and anonline web browser. Personal Information does not include information that hasbeen aggregated or made anonymous such that it can no longer be reasonablyassociated with a specific person.
Sharing & Disclosure of Information
Blue Idoes not own any data, information or material that you submit via theApplication. You, not Blue I, shall have sole responsibility for the accuracy,quality, integrity, legality, reliability, appropriateness, and intellectualproperty ownership or right to use of all data stored by You. Blue I shall not be responsible or liable forthe deletion, correction, destruction, damage, loss or failure to store anydata by You.
The useof this Application does not constitute doing business with Blue I and does not designate You as a customer of Blue I. It is your responsibility, and not the responsibility of Blue I, to maintain the security and accuracy of any information that You store via this Application on any mobile device you own orcontrol, or via a web browser. Further, while You are able to share thecontents of Your Insurance Agent Application, please note that sharing via anemail may not be secure. Blue I is not responsible for the security orconfidentiality of communications You send to us, or others, through theinternet or via e-mail messaging.

Termination
This Agreement commences when an account is activated by You. The term is indefinite and may be terminated at any time at either party’s discretion upon 30 daysnotice. In the event this Agreement is terminated (other than by reason of yourbreach), You have the option to send your information stored via theApplication to yourself via email. Yourinformation will be stored for 30 days after You terminate your account. You agree and acknowledge that Blue I has noobligation to retain the data stored by You, and may delete such data stored by You more than 30 days after termination.
Blue I reserves the right to withhold, remove and/or discard data stored by You without notice for any breach. Upon termination for cause, your right to access or use data stored by You immediately ceases, and Blue I shall have noobligation to maintain or forward any data stored by You.
Use of Information
Blue Idoes not sell or rent your Personal Information to marketers.
Blue Iand/or its third-party developers may have access to photos and information You add as a result of this Application. Additionally, all data will be disclosed to third parties as required by law or regulation and may be deemed discoverable by third parties.
Claims
As a result of involvement in an insurance claim, the data added via this Application may be deemed discoverable by third parties and used in claims investigation and/or litigation. Blue I and/or the participant may be legally required to provide the data to others involved in the claim or their legal counsel. If You are involved in a claim, You should not expect to retain data privacy or confidentiality of the data added through the Application.
Links To Other Web Sites
This Application may contain links to other sites. Blue I provides links to othersites as a convenience to persons who use the Application. If You choose to usethe services provided by those sites, You may be asked by those sites toprovide certain personally identifiable information (some of which may, on anindividual or aggregated basis, be shared with Blue I). Please be aware thatBlue I is not responsible for the privacy practices of those sites, even thoughthe Application name or logo may appear on those sites. We encourage You to beaware when You leave our Application; You should read the privacy policies ofeach web site that You visit, as the privacy policies of those sites may differfrom ours. Blue I is not responsible for the contents of any linked site or anylink contained in a linked site.
IntellectualProperty Ownership
Blue I alone (and its licensors, where applicable) shall own all right, title and interest, including all related Intellectual Property Rights, in and to the Blue I technology, the Application and any suggestions, ideas, enhancement requests, feedback, recommendations or other information provided by you or any other party relating to the Application. This Agreement is not a sale and does not convey to you any rights of ownership in or related to the Application, theBlue I technology or the Intellectual Property Rights owned by Blue I. TheApplication Name, the Application logo, and the product name associated withthe Application are trademarks of Blue I or third parties, and no right orlicense is granted to use them.
MutualIndemnification
You shallindemnify and hold Blue I, its licensors and each such party's parentorganizations, subsidiaries, affiliates, officers, directors, employees,attorneys and agents harmless from and against any and all claims, costs,damages, losses, liabilities and expenses (including attorneys' fees and costs)(“Losses”) arising out of or in connection with: (i) a claim alleging that useof the data stored by You infringes the rights of, or has caused harm to, athird party; (ii) a claim, which if true, would constitute a violation by Youof your representations and warranties; or (iii) a claim arising from Your useof the Application or otherwise arising under this Agreement, provided in anysuch case that Blue I (a) gives written notice of the claim promptly to You;(b) gives You sole control of the defense and settlement of the claim (providedthat You may not settle or defend any claim unless You unconditionally releaseBlue I of all liability and such settlement does not affect Blue I’s businessor Application and does not include a statement as to, or an admission offault, culpability or failure to act by or on behalf of Blue I); (c) providesto You all available information and assistance; and (d) has not compromised orsettled such claim.
Blue Ishall indemnify and hold You and your parent organizations, subsidiaries,affiliates, officers, directors, employees, attorneys and agents harmless fromand against any and all Losses arising out of or in connection with a claimalleging that the Application directly infringes a copyright, a U.S. patentissued as of the date an account is activated by You, or a trademark of a thirdparty; provided that You (a) promptly give written notice of the claim to BlueI; (b) give Blue I control of the defense and settlement of the claim (providedthat Blue I may not settle or defend any claim unless it unconditionallyreleases You of all liability and does not include a statement as to, or anadmission of fault, culpability or failure to act by or on behalf of, You); (c)provide to Blue I all available information and assistance; and (d) have notcompromised or settled such claim. Blue I shall have no indemnificationobligation, and You shall indemnify Blue I pursuant to this Agreement, forclaims arising from any infringement arising from the combination of theApplication with any of your products, service, hardware or businessprocess(s).
Severability
If anyprovision of this Agreement is held invalid, void or unenforceable, then thatprovision will be considered severable from the remaining provisions, and theremaining provisions shall remain in full force and effect.
Miscellaneous
You agreeto comply with all local, state, and federal laws, statutes, ordinances, andregulations that apply to your use of the Application.
Limitationof Liability
Except asset forth below, in no event shall either party’s aggregate liability exceed $500. In no event shall either party and/orits licensors be liable to anyone forany indirect, punitive, special, exemplary, incidental, consequential, or otherdamages of any type or kind (including loss of data, revenue, profits, use orother economic advantage) arising out of, or in any way connected with thisApplication, including, but not limitedto the use or inability to use the Application, or for any content obtainedfrom or through the Application, any interruption, inaccuracy, error oromission, regardless of cause in the content, even if the party from whichdamages are being sought or such party’s licensors have been previously advisedof the possibility of such damages.
Nolimitations or exclusions of liability shall apply with respect to any claimsbased on either party’s indemnities, gross negligence or willfulmisconduct.
